Exhibitor Guidelines
Assignment of Space
Early Stage East® (ESE) reserves the right to assign and change
booth location assignments at any time, as it may in its sole discretion
deem necessary.
General Security
Security services will be provided on the exhibit floor during
the entire period of the show (including move-in and move-out). Reasonable
efforts will be made to prevent loss. The final responsibility, however,
lies with the exhibitor.
Insurance
The exhibitor acknowledges that ESE, the Pier Five Hotel
does not maintain or is not responsible for maintaining insurance covering
personal injury to the exhibitor or the exhibitor's property and that
it is the sole responsibility of the exhibitor to obtain insurance covering
such loses or damages.
Subletting/Dividing of Space
No Exhibitor may assign, sublet or apportion the whole or
any part of the space, unless authorized by ESE.
Exhibitor Cost
Exhibitor fees cover only those items described in the sponsors
opportunities list presented on this website. Any other booth furnishings
and equipment must be contracted through ESE. Please contact ESE at 302-777-2460
if you have any additional needs.
Cancellation
No refunds for exhibit space or sponsorship will be issued.
Failure to Hold Exhibition
ESE shall not be financially obligated or otherwise committed
in the event of the Conference being cancelled or deferred on account
of damage to the building, strikes, fires, casualties, Acts of God or
causes beyond their control with no other liability then to refund the
exhibit space fee, less a proportionate share of the exposition costs
incurred.
Liability and Indemnification
Neither ESE, nor the Pier Five Hotel shall be liable for
damage, loss or destruction of the exhibits by reason of fire, theft,
accident or any other causes, and each exhibitor shall rent exhibit space
at their own risk. Neither ESE, nor the Pier Five Hotel nor any of their
employees, agents, volunteers or contractors will be accountable or liable
for accidents to exhibitors, their employees, agents, volunteers or servants.
The exhibitor will be liable to ESE, the Pier Five Hotel
for any damage done to the building and/or the furniture and fixtures
therein which shall occur through the acts or omissions of the exhibitor,
its employees, agents or contractors.
The exhibitor agrees to indemnify, and hold harmless and
defend ESE and the Pier Five Hotel against any liability, claim or expense
resulting from injury or damage to any person or property which occurs
within the exhibitor's exhibit space or as the result of any act or omission
of the exhibitor, its employees, agents or contractors.
Hold Harmless Clause
It is understood that the Pier Five Hotel and ESE, nor the
legal entities which own, lease and/or operate the Pier Five Hotel and
ESE, nor their members, officers, directors, volunteers or employees
shall be responsible or liable for any injury to any person or persons
or for the loss or damage to any person or persons in the Pier Five
Hotel or otherwise.
The exhibitor assumes complete responsibility and liability
for all loss, damage or destruction of the property of the exhibitor,
his/her guests and all property of ESE and the Pier Five Hotel used by
the exhibitor, or brought upon the Pier Five Hotel premises in his/her
behalf.
The exhibitor also assumes complete responsibility and liability
for all injury to any and all persons or property or in any way connected
with the exhibitor's display caused by the exhibitor's employees. The
exhibitor indemnifies and agrees to hold harmless ESE and the Pier Five
Hotel, their members, officers, directors, volunteers and employees against
any and all liability whatsoever arising from any of all damage to property
or personal injury caused by the exhibitor or his/her agents, representatives,
employees or any other person.
